Terms of Service

1. Acceptance of Terms

By accessing or using the GrowQR platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

GrowQR provides URL shortening, QR code generation, campaign management, analytics tracking, and related marketing tools. The Service is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue any feature at any time.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Shorten URLs that link to malware, phishing sites, or illegal content
• Send spam or unsolicited bulk messages using short links
• Impersonate any person or entity
• Violate any applicable laws or regulations
• Interfere with or disrupt the Service or its infrastructure
• Circumvent usage limits, rate limits, or security measures
• Scrape, crawl, or harvest data from the Service without permission

We reserve the right to suspend or terminate accounts that violate these terms and to disable any short link at our sole discretion.

5. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by GrowQR and protected by intellectual property laws. You retain ownership of the content you create (e.g., custom aliases, landing pages), but grant us a license to host and display it as necessary to provide the Service.

6. Pricing and Payments

Paid plans are billed monthly or annually as selected at checkout. Prices are subject to change with 30 days' notice. Refunds are available within 14 days of purchase for annual plans. All fees are non-refundable after the refund period. Failure to pay may result in downgrade to the Free plan.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You acknowledge that click data (IP addresses, geographic location, device information) is collected when users interact with your short links. You are responsible for disclosing this data collection in your own privacy policies where required.

8. Service Level

We strive for 99.9% uptime for all paid plans. Enterprise customers may have separate SLA agreements. We do not guarantee uninterrupted service and will not be liable for temporary outages, scheduled maintenance, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by law, GrowQR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.

10. Termination

You may close your account at any time from your dashboard settings. We may terminate or suspend your account if you violate these Terms. Upon termination, your short links may be disabled and your data deleted after a 30-day grace period.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance.
